These Terms and Conditions (“Terms”) govern the provision of photobooth rental and photography services (“Services”) by Starling Crew (Pty) Ltd, trading as Jetstream Studio (“Service Provider”), a company registered in South Africa, to clients (“Client”) booking our Services. By booking our Services, the Client agrees to be bound by these Terms.

  1. Services Offered

    1.1. Photobooth Rental Services
    The Service Provider offers photobooth rental services as per the packages listed on www.jetstreamstudio.co.za. Each package includes:

      • Booth operators
      • Instant printing of photo strips

      • Setup and breakdown of the photobooth

      • Standard backdrop (as listed on the website)

      • Custom photo strip design (subject to specifications in Section 3)

      • Digital gallery with high-quality photos delivered within 2 business days post-event Any additional items or services not included in the selected package will incur additional charges, as agreed upon in writing.

    1.2. Photography Services
    The Service Provider offers photography services booked on a per-hour basis at R800 per hour. Each hour booked includes:

    • The presence of a professional photographer on-site for the duration of the booked hour

    • A set of 25 edited photos delivered digitally for each hour booked. Additional edited photos beyond the included 25 per hour may be purchased at R500 per set of 25 photos.

  1. Booking and Payment Terms

    • Deposits
      • A deposit of 50% of the total fee is required to secure a booking for either photobooth or photography services. This deposit is fully refundable if the booking is cancelled at least 14 business days prior to the event date.
      • If cancellation occurs within 14 business days of the event, the deposit will be forfeited.

    • Full Payment
      • Full settlement of the outstanding balance must be made no later than 3 business days prior to the event date.

      • Failure to settle the full amount by the specified deadline will result in the Service Provider not attending or providing services at the event.

    • Extended Services
      • For photobooth services, if the Client requires the Service Provider to extend services beyond the agreed duration, an additional fee of R850 per hour or part thereof will be charged, payable immediately after the event.

      • For photography services, if the Client requires the Service Provider to extend services beyond the agreed duration, an additional fee of R800 per hour or part thereof will be charged, payable immediately after the event.

    • Additional Photography Purchases
      • Additional edited photos for photography services may be purchased at R500 per set of 25 photos, with payment due upon order confirmation.

    • Payment Method
      • Payments must be made via bank transfer to the account details provided by the Service Provider.

  1. Photobooth Photo Strip Design

    • The Client may request a customized photo strip design for photobooth services, provided the design fits on a 4 x 6 inch photopaper and leaves sufficient space for the photographs.

    • The Service Provider will provide a proof of the design for Client approval prior to the event.

    • Any revisions to the design after approval may incur additional charges.

  2. Deliverables

    • Photobooth Services

      • On the event day, the Client will receive one printed copy of each photo strip produced during the event.

      • A digital gallery containing high-quality photos will be provided via a secure online link within 2 business days following the event.

    • Photography Services
      • For each hour booked, the Client will receive a set of 25 edited photos, delivered via a secure online digital gallery within 5 business days following the event.

      • Additional purchased photos will be delivered within 5 business days of payment confirmation.

  1. Backdrops (Photobooth Services)

    • Standard backdrops, as displayed on www.jetstreamstudio.co.za, are included in the photobooth package price.

    • Custom backdrops or designs requested by the Client will incur additional charges, to be quoted and agreed upon in writing prior to the event.

  2. Travel Fees

    • A travel fee of R5 per kilometer (calculated for the round trip) will be charged for all events, with distances measured from the Sinoville Corner Shopping Centre in Sinoville, Pretoria.

  3. Packages and Promotions

    • Available packages for both photobooth and photography services are exclusively listed on www.jetstreamstudio.co.za.

    • Any promotional offers will be advertised on the Service Provider’s social media channels, with specific terms and conditions published on the website.

  4. Client Responsibilities

    • Provide a suitable, safe, and accessible space for the photobooth setup or photography services, including access to a power source (for photobooth) or necessary areas of the venue (for photography).

    • Ensure timely communication regarding event details, design preferences (for photobooth), or specific photography requirements (e.g., shot lists).

    • Obtain any necessary permissions or permits for the photobooth setup or photography at the venue.

  5. Cancellation and Refunds

    • The 50% deposit is fully refundable if cancellation is made at least 14 business days prior to the event date. If cancellation occurs within 14 business days of the event, the deposit will be forfeited.

    • Cancellations made less than 14 days prior to the event will result in the forfeiture of the full payment.

    • The Service Provider reserves the right to cancel the booking if full payment is not received by the deadline, with no obligation to provide services.

  6. Liability

    • The Service Provider is not liable for any damages, injuries, or losses incurred during the event unless caused by gross negligence or willful misconduct.

    • The Client is responsible for any damage to the Service Provider’s equipment (photobooth or photography equipment) caused by the Client or their guests, with repair or replacement costs charged to the Client.

  7. Use of Images and Content

    • The Client grants the Service Provider the right to use images, photo strips, or other content captured during the event for promotional purposes on the Service Provider’s website (www.jetstreamstudio.co.za) and social media channels.

    • The Service Provider will ensure that any use of such content complies with applicable privacy laws and will not include identifiable images of individuals without prior consent, where required.

    • The Client may request in writing, prior to the event, that specific images or content not be used for promotional purposes, and the Service Provider will comply with such requests.

  8. Force Majeure
    The Service Provider shall not be liable for failure to perform services due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, or government restrictions.

  9. Governing Law
    These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in Pretoria, South Africa.

  10. Amendments
    The Service Provider reserves the right to update or modify these Terms at any time, with changes published on www.jetstreamstudio.co.za. Clients will be notified of any changes affecting existing bookings.

By booking our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

Welcome to www.jetstreamstudio.co.za (“the Website”), offering professional services including web design, SEO, graphic design, branding design, consulting, UI/UX design, app development, and e-commerce solutions (“Services”). By engaging with the Website or Services, you agree to be bound by the following Terms and Conditions (“Terms”). These Terms apply to all clients globally. Please read them carefully.

  1. Acceptance of Terms
    By accessing the Website or contracting Services, you (“the Client”) agree to these Terms. If you do not agree, you may not use the Website or Services. Jetstream Studio reserves the right to update these Terms at any time, with changes effective upon posting to the Website.

  2. Scope of Services
    Jetstream Studio provides the following freelance services on a global scale:
    1. Web design
    2. Search Engine Optimization (SEO)
    3. Graphic design
    4. Branding design
    5. Consulting
    6. User Interface (UI) and User Experience (UX) design
    7. App development (managed by Jetstream Studio, executed by third-party service providers)
    8. E-commerce solutions

      All Services are subject to a project-specific quotation provided to the Client, outlining the scope, deliverables, and estimated timeline. For app development, Jetstream Studio acts as the project manager, coordinating with third-party service providers to deliver the project.

  3. Payment Terms
    1. Deposit: A non-refundable upfront deposit of 50% of the quoted project cost is required before work begins.
    2. Final Payment: The remaining 50% balance must be paid in full prior to the final handover of the project deliverables.
    3. Staging Environment: For web design and e-commerce projects, a live version of the website will be presented in a staging environment for Client review and approval before final payment is due.
    4. Additional Costs: Any subscriptions, product keys, API keys, licenses, or other costs not explicitly included in the quotation are the Client’s responsibility and must be paid directly by the Client.
    5. Payments must be made via the payment method specified in the quotation (e.g., bank transfer, PayPal, or other agreed methods).
    6. Late payments may incur a 5% late fee per week, up to a maximum of 20% of the outstanding balance.
  4. Project Approval and Revisions
    1. Staging Review: For web design and e-commerce projects, the Client will have the opportunity to review the project in a staging environment. Feedback must be provided within 7 business days unless otherwise agreed.
    2. App Development Review: For app development projects, progress updates and deliverables will be provided by Jetstream Studio as coordinated with third-party service providers. Feedback must be provided within 7 business days unless otherwise agreed.
    3. Revisions: The quotation includes a specified number of revisions (typically up to two rounds). Additional revisions may incur extra charges at the standard hourly rate of $25/hour.
    4. Approval: Final approval of the project (in the staging environment for web/e-commerce or final deliverables for other services) constitutes acceptance of the work. Once approved, final payment is due, and no further revisions will be made unless agreed upon at an additional cost.
  5. Client Responsibilities
    1. The Client must provide all necessary materials (e.g., content, images, logos, or access to third-party accounts) in a timely manner as specified in the project agreement.
    2. Delays in providing materials may result in project delays, for which Jetstream Studio is not liable.
    3. The Client is responsible for ensuring all provided materials do not infringe on third-party intellectual property rights.
  6. Third-Party Service Providers
    1. For app development projects, Jetstream Studio acts as the project manager, coordinating with third-party service providers to deliver the project. These providers are vetted for quality and reliability, but Jetstream Studio is not liable for their performance or any issues arising from their work.
    2. Any additional costs associated with third-party providers (e.g., licenses, subscriptions, or unforeseen fees) not included in the quotation are the Client’s responsibility.
    3. Jetstream Studio will facilitate communication and ensure project milestones are met but does not directly perform app development tasks.
  7. Intellectual Property
    1. Ownership: Upon full payment, the Client is granted ownership and full usage rights of the final deliverables, subject to any third-party licenses (e.g., fonts, stock images, or software).
    2. Pre-existing Materials: Jetstream Studio and any third-party service providers retain ownership of any pre-existing materials, tools, or code used in the project, granting the Client a non-exclusive license to use them as part of the deliverables.
    3. Portfolio Rights: Jetstream Studio reserves the right to showcase the project in their portfolio, including on the Website, social media, or other promotional materials, unless otherwise agreed in writing.
  8. Third-Party Services and Costs
    1. Any subscriptions, product keys, API keys, licenses, hosting fees, or other third-party costs not explicitly included in the quotation are the Client’s responsibility.
    2. Jetstream Studio may recommend third-party services (e.g., hosting providers, payment gateways, or app development platforms) but is not liable for their performance, availability, or associated costs.
  9. Project Timeline and Delays
    1. Project timelines are estimates provided in the quotation and are subject to change based on the Client’s responsiveness, feedback, or third-party service provider performance.
    2. Delays caused by the Client (e.g., late submission of materials or feedback) or third-party providers may extend the timeline, and Jetstream Studio is not liable for such delays.
    3. If a project is delayed by the Client for more than 30 days without communication, Jetstream Studio reserves the right to consider the project abandoned, with the deposit non-refundable.
  10. Cancellation and Refunds
    1. Client Cancellation: If the Client cancels the project after work has begun, the 50% deposit is non-refundable. Any additional work completed beyond the deposit will be invoiced based on the percentage of completion at the standard hourly rate of $25/hour.
    2. Termination by Jetstream Studio: Jetstream Studio reserves the right to terminate the project if the Client breaches these Terms (e.g., non-payment or failure to provide required materials). In such cases, the deposit is non-refundable, and any completed work will be invoiced.
    3. No refunds will be issued for completed work or after final project approval.
  11. Limitation of Liability
    1. Jetstream Studio is not liable for any indirect, incidental, or consequential damages arising from the use of the Website or Services, including but not limited to loss of profits, data, or business opportunities.
    2. Services, including those provided by third-party service providers, are provided “as is,” and Jetstream Studio does not guarantee that deliverables will be error-free or meet all Client expectations beyond the agreed scope.
    3. The total liability of Jetstream Studio shall not exceed the amount paid by the Client for the specific project.
  12. Confidentiality
    1. Jetstream Studio will treat all Client-provided information as confidential and will not disclose it to third parties without consent, except as required by law.
    2. The Client agrees not to share any proprietary tools, processes, or materials provided by Jetstream Studio or third-party service providers with third parties.
  13. Governing Law and Dispute Resolution
    1. These Terms are governed by the laws of South Africa.
    2. Any disputes arising from these Terms or the Services will be resolved through negotiation. If unresolved, disputes will be subject to the exclusive jurisdiction of the courts in Cape Town, South Africa.
  14. Force Majeure
    1. Jetstream Studio is not liable for delays or failure to perform Services due to circumstances beyond reasonable control, including but not limited to natural disasters, internet outages, or third-party service provider failures.
